Terms of Service

Please read these Terms carefully. By applying for a pilot, accessing, or using the Claritect platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Claritect platform, website, and related services (collectively, the "Service"), operated by Claritect ("we", "our", "us"), a business registered in India.

By clicking "Accept", submitting a pilot application, or otherwise accessing the Service, you confirm that you are authorised to act on behalf of your organisation and that your organisation agrees to these Terms.

5. Database Access & Data Ownership

You retain full ownership of your data at all times. Claritect does not claim any rights over the contents of your database or the reports generated from it.

By connecting a database, you grant Claritect a limited, read-only, non-transferable licence to access that database solely for the purpose of providing the Service to you. This licence terminates immediately upon termination of your account.

We will not access your database for any purpose other than responding to report requests you initiate.

6. Intellectual Property

Our IP: The Claritect platform, including its AI models, interface, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written consent.

Your IP: Reports generated by Claritect using your data are your property. You may use, share, and distribute them freely.

Feedback: If you provide feedback or suggestions about the Service, we may use that feedback without obligation to you.

7. Confidentiality

Both parties agree to keep confidential any non-public information received from the other party in connection with the Service. This obligation survives termination of these Terms for a period of three (3) years.

Our confidentiality obligations with respect to your data are described in our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

Reports generated by Claritect are decision-support tools. You are responsible for verifying the accuracy of any information before making business decisions based on it.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Claritect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.

Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the claim (or INR 1,000 if you are a free pilot customer).

10. Termination

Either party may terminate access to the Service at any time by providing written notice. We may terminate or suspend access immediately if you breach these Terms or if we determine (in good faith) that continued access creates a security or legal risk.

Upon termination, your right to use the Service ceases immediately. We will delete your database credentials within 30 days. Reports you have already exported remain yours.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India.

Before initiating formal proceedings, both parties agree to attempt to resolve disputes in good faith through direct negotiation for at least 30 days.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
